Cannabis Companies Ask for Ease of F.D.A. Rules on CBD Products

As cannabis starts to be decriminalized across the country, cannabis companies seek easing of regulation on CBD.

While F.D.A. hearings are rarely a raucous affair, more than 400 applicants from the U.S. Hemp Roundtable last month fought for a chance to testify for and against the impact of CBD policy.

Pro-CBD congress adds pressure

Under pressure from Congress to make cannabis-derived products easier to sell, the F.D.A. has had to shelve its scepticism of the ever-increasing cannabis industry. CBD does not fall under the medical marijuana legislation, now approved in many states which permits doctors to prescribe cannabis products for nausea, pain and other symptoms.

Thankfully, in 2018 the farm bill removed hemp and cannabis–derivatives such as CBD from the F.D.A. list of controlled substances, provided that 0.3 percent THC exists within them. The World Health Organisation weighed in that CBD has no addictive effects and a strong safety profile.

“Congress had the expectation that CBD from hemp would be able to be put in the food supply when they passed the farm bill,” Dr. Scott Gottlieb, former F.D.A. Commissioner said, “but it very explicitly preserved F.D.A.’s authority, so the F.D.A. has to create a framework for it to be contemplated as a component in food.”

Monitoring marijuana is a tough job that is spread over multiple agencies. The Drug Enforcement Administration permits cannabis processing and growing for medical purposes, while the Department of Agriculture is working on regulating hemp production, another cannabis by-product. Hemp policy can also be set on state-by-state terms.

Marc Scheineson of Alston & Bird in Washington, D.C. law firm who represented his CBD client at the hearing said “this is a new gold rush. The horse is so far out of the corral here that it will be interesting to see what F.D.A. decides to do — or can do at this point.”
